Terms of Service

These Terms of Service ("Terms") govern your access to and use of PayRescue ("PayRescue", "we", "us"). PayRescue is operated by 9GG LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA. By creating an account or using the service, you agree to these Terms.

1. The service

PayRescue is an agentic failed-payment recovery tool for subscription businesses. It detects declined Stripe charges, runs a smart retry ladder, and sends tone-laddered recovery emails containing a card-update link, and reports recovered revenue. You are responsible for connecting your own Stripe account and for the accuracy of the data you provide.

2. Accounts

You must provide a valid email and verify it before logging in. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 and authorised to bind the business you represent.

3. Fees

Performance plan: 20–25% of revenue successfully recovered. Free to start — you pay only when we recover.
Flat plan: $49/month plus a lower percentage of recovered revenue.

Fees are billed in arrears based on recovered amounts. Plans may be changed or cancelled at any time; cancellation stops future recovery activity but does not refund fees already earned on recovered revenue.

4. Your responsibilities & acceptable use

PayRescue automates retries and messaging on your behalf. You remain responsible for compliance with card-network rules, applicable laws (including anti-spam and consumer-protection laws), and your own agreements with your customers. See our Disclaimer.

You agree not to use PayRescue to send unlawful, deceptive, or harassing communications, to process payments you are not authorised to collect, or to violate Stripe's or any email provider's policies.

5. Third-party services

The service relies on third parties including Stripe, Resend, and AI providers (DeepSeek/Anthropic). Your use of those services is also subject to their terms. We are not responsible for outages or actions of third-party providers.

6. Intellectual property

PayRescue and its software, branding, and content are owned by 9GG LLC. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You retain ownership of your data.

7. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee any specific recovery rate or amount. Outcomes depend on your customers, their banks, and card networks.

8. Limitation of liability

To the maximum extent permitted by law, PayRescue and 9GG LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue. Our aggregate liability is limited to the fees you paid us in the three months preceding the claim.

9. Indemnity

You agree to indemnify and hold harmless 9GG LLC from claims arising out of your use of the service, your data, or your violation of these Terms or applicable law.

10. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms or to comply with law.

11. Governing law & changes

These Terms are governed by the laws of the jurisdiction of 9GG LLC's principal place of business. We may update these Terms; continued use after changes constitutes acceptance.
